What if an heir or beneficiary is under 18?

A child’s entitlement must be protected and cannot simply be paid to any relative.

The child can inherit

Minority does not by itself remove an inheritance entitlement. It changes how the share is administered, held or transferred. The will, the nature of the asset and the applicable court arrangements must be reviewed together.

Court-supervised arrangements may apply

Section 46 of Cap. 189 and the Rules for the Administration of Estates of Minors provide procedures concerning a minor’s share, including applications about transfer and guardianship of the property where required. The court can direct how the share is dealt with for the child.

Do not confuse parenthood with authority over the asset

A parent or caregiver is not automatically free to receive, sell or spend every inherited asset belonging to a child. Establish the legal authority and any safeguards, accounts or approvals before transferring estate property.

Information to prepare

Bring the child’s civil-status documents, the will or intestacy information, details of the proposed representative and a description and value of the inherited assets. Explain any urgent maintenance, education or property-management need.
